1. Identity of the data controller

2. Applicability
These terms and conditions apply to all bookings, agreements and sales of kittens from AlmuñéCats Cattery.
By signing the sales agreement, the buyer confirms that they have read and agree to these terms and conditions.
Any deviations from these terms and conditions are only valid if confirmed in writing by AlmuñéCats.
3. Booking
A kitten is only reserved after:
– written confirmation,
– receipt of the agreed deposit,
– and signing of the sales agreement.
The deposit is €300, unless otherwise agreed in writing.
The deposit will be deducted from the total purchase price.
In the event of cancellation by the buyer, the deposit will not be refunded.
If the sale does not go ahead due to circumstances on the part of the cattery, such as illness, death or unsuitability of the kitten, the amount paid will be refunded or an alternative may be offered by mutual agreement.
4. Retention of title
The kitten remains the sole property of AlmuñéCats until the full purchase price has been paid.
The outstanding balance must be paid in full before or at the latest upon handover of the kitten.
In the event of non-payment, AlmuñéCats reserves the right to terminate the agreement.
5. Delivery and transfer
A kitten will only be handed over if:
– it is at least 12 weeks old,
– it has been declared clinically healthy,
– it has been vaccinated in accordance with its age,
– it has been microchipped,
– it has a European pet passport.
If required by law or in accordance with applicable regulations, a kitten may be handed over after being neutered or spayed.
An official pedigree will be requested from the recognised breed association for each kitten.
If the pedigree is not yet available at the time of transfer, it will be sent on as soon as it has been officially issued.
Following transfer, the buyer is responsible for the correct registration of the microchip in accordance with applicable national or regional regulations.
Transport by third parties is entirely at the buyer’s risk.
From the moment of transfer, the full risk passes to the buyer.
6. Health and guarantees
The kittens are bred with the utmost care and undergo a clinical examination prior to handover.
AlmuñéCats cannot provide an absolute guarantee against:
– latent conditions,
– genetic abnormalities that develop later in life,
– viral mutations,
– FIP (Feline Infectious Peritonitis),
– stress- or environment-related conditions,
– illnesses arising after handover.
If a serious congenital defect is diagnosed by a qualified vet within 7 days of handover, this must be reported immediately in writing, including a written statement from the vet.
Any liability is limited to a maximum of the purchase price.
7. Obligations of the buyer
The buyer undertakes to provide:
– proper care,
– suitable accommodation,
– high-quality food,
– timely veterinary care,
– compliance with vaccination and health advice.
AlmuñéCats leaves the choice of indoor or outdoor accommodation to the owner, provided that the animal’s welfare and safety are adequately safeguarded.
Use for breeding purposes is permitted only if this has been agreed in writing in advance.
The buyer remains responsible for compliance with applicable laws and regulations regarding the keeping, registration or breeding of animals.
Resale or transfer to third parties without the prior consent of AlmuñéCats is not permitted.
8. Rehoming
If the buyer is no longer able to keep the animal, please notify AlmuñéCats.
The cattery reserves the right to assist in finding a suitable new home.
9. Liability
Once the kitten has been handed over, the buyer is fully responsible for it.
AlmuñéCats accepts no liability for:
– damage caused by the animal,
– veterinary costs incurred after handover,
– illnesses arising after handover,
– consequences of improper care,
– incidents beyond the cattery’s control.
Liability is only possible in the event of demonstrable gross negligence prior to transfer and is limited to the purchase price.
10. Force majeure
In the event of force majeure, including illness, the death of the animal, natural disasters, transport problems, government measures or other unforeseen circumstances, AlmuñéCats reserves the right to cancel or suspend the agreement.
Any amounts paid will be refunded in such cases.
11. Applicable law
All contracts and sales are governed by Spanish law.
Any disputes shall be submitted to the competent courts of Spain.
